This Privacy Policy explains how we collect, use, store, protect, and share your personal information through our services.
Aloha! is committed to your privacy. This Privacy Statement describes the types of information we collect from and about you when you visit our website alohahey.com (the “Site”), use our computer or mobile applications each an “App”),or use our online services (the Site, App, and online services are collectively, the “Service”).
This Privacy Statement also explains how Aloha! may use and disclose such information,as well as your ability to control certain uses of it. This includes any information you choose to provide that is deemed sensitive under applicable law.
When this policy mentions “we” or “us” or “aloha ” or “aloha!” it refers to the controller of your information under this policy.
It’s important that you read this entire policy, but here’s a summary to get you started:
We care a lot about privacy. We are committed to creating spaces where people can talk, hang out and have fun with friends online. Respecting user privacy is a key part of that mission.
We don’t sell your personal information. Our business is based on subscriptions and paid products, not from selling your personal information to third parties.
We limit what information is required. We require the information that enables us to create your account, provide and maintain our services, meet our commitments to our users, and satisfy our legal requirements. The rest is optional.
We care deeply about safety. Our dedicated Trust and Safety team works hard to help keep our community safe. We also use certain information to help us identify violations of our Community Guidelines and prevent harmful content from being distributed through the services.
We give you control. We give you the ability to control your privacy on Aloha!.
The information we collect
We collect certain information when you use Aloha! This includes information you provide to us, information we collect automatically, and information we receive from other sources.
Information you provide to us
Account information. When you create a Aloha! account, you can come up with a username and password, and provide a way of contacting you (such as an email address and/or phone number). You’ll also need to provide your birthday. In some cases, we may require additional information to verify your age. You may be required to verify your account or provide additional information (like a verified phone number) to your account. You may also have the option to add your name or choose a display name.
Content you create. This includes any content that you upload to the service. For example, you may write messages or posts (including drafts), send voice messages, create custom emojis, or post other content that you create with features that we develop. You may also upload and share files through the services. This also includes your profile information and the information you provide when you create servers. We generally do not store the contents of video or voice calls or channels. If we were to change that in the future (for example, to facilitate content moderation), we would disclose that to you in advance. We also don’t store streaming content when you share your screen, but we do retain the thumbnail cover image for the stream for a short period of time. We may build features that help users engage with voice and video content, like create or send short recordings.
Payment information. If you buy any paid services through Aloha!, you may need to submit a valid payment method and associated billing information, including your full name and billing address. Our payment processors, like Stripe and PayPal, receive and process your payment information. Depending on the processor, we may also receive and store certain billing information, including the last four digits of the credit card number associated with the transaction. If you sell something through Aloha!, you may be required to provide additional information to Aloha! or to our payment processors, such as bank account information to facilitate payments, tax identification information, and copies of government issued identification required to identify users in accordance with regulatory obligations. If we decide to process our own payments in the future, we would receive and process this information ourselves.
Information from actions you take. We collect information about your use of Aloha! and your activities on the services. This includes information such as the friends you add, the users, bots, and apps you engage with, the games you play on your device, the servers or other communities you join and participate in, your roles in servers, content moderation decisions you make, information about purchases or sales you make on or through Aloha! including what you purchased or sold, and other related actions. You can control the extent to which we collect, use, and display this information as described in the “How to control your privacy” section below.
Information from optional features. Certain features, like contact syncing, may require that you provide additional information (or grant us access to such information) to make them work. This also includes third-party integrations you choose to enable and the data you authorize those third-party services to share with us. For example, when you link a music streaming account, we may collect information about that account such as the song you are listening to in order to display that information on your profile or as your status (if you have chosen to do so).
Other information you provide directly to us. You may have the option to submit additional information as you use Aloha!. For example, you may participate in surveys where you can provide feedback on the services, or submit information to our Aloha! Support teams.
Information we collect automatically
We also collect information automatically from you when you use Aloha! This includes:
Information about your device. We collect information about the device you are using to access the services. For example, this includes information like your IP address, operating system information, browser information, and information about your device settings, such as your microphone and/or camera.
Information about your use of the apps or websites. For example, we collect log and event information related to how and when you use our services (such as the pages, servers, and channels you visit, the activities you engage in, the features you use, and the surfaces or embedded content you interact with).
Other information that we collect automatically. When you take certain actions on other sites, we may receive information about you. For example, when we advertise for Aloha! on third party platforms, if you click on the ad, we may receive information about which ad you saw and on which platform. Similarly, we may also receive certain information when you click on a referral link, such as which website you came from.

Information we receive from other sources
We may receive information about you from other sources, including from other users and third parties, and combine that information with the other information we have about you. For example, if you interact with our social media account on another platform, we may receive certain information about you like your username on that platform.
Cookies
We use cookies to operate and provide our services including to provide our services that are web based. We use cookies to identify which pages on our website our most popular, and remember your preferences like language preference for example.
Status Information
We collect information about your online status including when you are online and when you are disconnected from the Aloha! servers.
Why We Collect Information
We rely on a number of legal bases to collect, use, share, and otherwise process the information we have about you for the purposes described in this Privacy Policy, as follows:
As necessary to provide the Services and fulfill our obligations pursuant to the Terms of Service, having the “fulfillment of the agreement” as ground of processing.
Where you have consented to the processing, which you can revoke at any time. For example, you may consent to the processing of phone contacts information.
Where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims.
Where necessary for the purposes of Aloha!'s or a third party’s legitimate interests, such as those of visitors, members or partners, as detailed below in the “Our Legitimate Interests” section.
Our Legitimate Interests
We process your information in furtherance of our legitimate interests, including:
Improving the Services, including any personalized Services. We do so as it is necessary to pursue our legitimate interests of providing and developing innovative and tailored offerings to our members on a sustained basis;
Keeping the Services safe and secure. We do so as it is necessary to pursue the legitimate interests of Aloha! and its members in ensuring the Services are secure, and to protect against fraud, Spam and abuse, etc. and
Promoting Aloha! and/or our partners. We do so as it is necessary to pursue our legitimate interest to promote Aloha! and/or our partners, increase our reach and visibility and spread the word about Aloha!
Aloha! may share information regarding your activity on Aloha! (including rewards/winnings received, or rankings achieved) for the purpose of promoting Aloha! and/or our partners. Such information may consist of your user name, avatar, and country. The information will be included in announcements or social media posts made by Aloha! through its own website, blog, social media accounts, advertising materials and / or media channels.
You have the right to opt out at any time from such disclosure by selecting the “Anonymous Identity” option, available in the “Leaderboard Privacy” section of the app’s Settings.
Information use
Aloha! may use the information we collect from and about you for any of the following purposes and we will limit the processing of such information to such purposes only:
To fulfill orders, provide service and communicate with customers;
To develop new products or services;
To respond to your inquiries;
To provide you with customized Service content, targeted offers, and advertising on the Service or on other sites;
To contact you with information, newsletters and promotional materials from Aloha! or on behalf of our partners and affiliates;
To contact you when necessary;
To review the usage and operations of our Service and improve our content, products and services;
To address problems with the Service or our business;
To manage our telecommunications networks;
To protect the security or integrity of the Service and our business;
As described to you at the point of data collection; and
To use and disclose your credit/debit card information only to process payments and prevent fraud.
Information disclosure
Aloha! may disclose the information we collect from and about you as follows: (1) to our Service Providers, if the disclosure will enable them to perform a business, professional or technical support function for us; (2) as necessary if we believe that there has been a violation of the Aloha! Terms of Use or of our rights or the rights of any third party; (3) to respond to judicial process and provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (4) as described to you at the point of collection. Except as described in this Privacy Statement, we will not share, sell, rent, or lease your personal information to a third party for its own use.
Aloha! may share aggregate or anonymous non-personal information with third parties.
Also, Aloha! may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal information provided through this Service in a manner that is consistent with this Privacy Statement.
EU members rights
If you are habitually located in the European Union, you have the right to access, rectify, download or erase your information, as well as the right to restrict and object to certain processing of your information. While some of these rights apply generally, certain rights apply only in certain limited circumstances. We describe these rights below:

You can access much of your information by logging into your account. If you require additional access or if you are not a Aloha! member, contact us at support@alohahey.com. To receive a copy of your data, contact us.
Rectify, Restrict, Limit, Delete
You can also rectify, restrict, limit or delete much of your information by logging into your account. If you are unable to do this, please contact us at support@alohahey.com.
Object
Where we process your information based on our legitimate interests explained above, or in the public interest, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons.
Revoke Consent
Where you have previously provided your consent, such as to permit us to process data about you, you have the right to withdraw your consent to the processing of your information at any time. You can do this from the app, or in case you are not able to do it yourself, please contact us at support@alohahey.com. Revoking permissions, may cause the application to malfunction and no earnings will be shared with you. In certain cases, we may continue to process your information after you have withdrawn consent if we have a legal basis to do so or if your withdrawal of consent was limited to certain processing activities. The processing undergone until the withdrawal of consent remains lawful.
Addressing the data protection authority
If you disagree with the way Aloha! processes your personal information, you have the right to address to the competent data protection authority and to file a complaint therewith.
Transfers
Aloha! shares information globally, both internally within The Group of Companies, and externally with businesses, service providers, and partners and with those you communicate with around the world. Your information may, for example, be transferred or transmitted to, or stored and processed in the United States or other countries outside of where you live for the purposes as described in this Privacy Policy.
Retention of Information
We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until you ask us to delete it or your account is deleted whichever comes first.
Information about you that is no longer necessary and relevant to provide our Services may be de-identified and aggregated with other non-personal data to provide insights which are commercially valuable to Aloha!, such as statistics of the use of the Services.
Service Providers
Aloha! may contract with third parties to perform functions related to the Service (“Service Providers”). Service Providers will have access to your information needed to perform their business functions, but may not use or share that information for other purposes.
Public Forums
Any information you may disclose to your network of connections on our Service, in blogs, on message boards, in chat rooms, or on other public areas on the Service, becomes public information. Please exercise caution when disclosing personal information in these public areas.
Links to other websites
The Service may have links to third-party websites or applications, which may have privacy policies that differ from our own. We are not responsible for the practices of such sites or applications.
Our commitment to children’s privacy
Protecting children’s privacy is important to us. We do not direct the Service to, nor do we knowingly collect any personal information from, children under the age of sixteen.

We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Site visitors.
